The Dallas Bar Association has prepared a resolution in opposition to Texas Senate Bill (985) which seeks to eliminate Dallas County Courts at Law numbers 3, 4, and 5. Though the Dallas Bar Association is historically reticent to comment on pending legislation, we feel that this reduction in courts would result in multiple negative consequences for Dallas County citizens and those who work with the Dallas County Court system.
The resolution reads:
R E S O L U T I O N
WHEREAS, the Dallas Bar Association, with over 11,000 members, is the largest bar association for attorneys in and around Dallas County, Texas. The Association is a non-political entity that is historically reticent to comment on pending legislation. Senate Bill 985, which seeks to eliminate three of the five Dallas County Courts at Law, is an exception, and;
WHEREAS, the reduction in courts would result in multiple negative consequences for Dallas County citizens and those who work with the Dallas County court system, and;
WHEREAS, Dallas County Courts at Law have concurrent jurisdiction with the Dallas County Civil District Courts. As such, the Dallas County Courts at Law preside over matters similar to their District Court counterparts, in addition to receiving appeals from Justice of the Peace Courts, and;
WHEREAS, the Dallas Civil District Judges recently published their opposition to Senate Bill 985. As they note, Dallas County Civil District Courts are at maximum capacity. Despite increasing population and increasing demands on the Courts, the legislature has not created a new civil district court in Dallas County in more than 30 years, and;
WHEREAS, a dramatic reduction of courts will inevitably shift burdens to what would be the remaining two County Courts at Law and Civil District Courts, further prolonging the litigation process for citizens and litigants in Dallas County, be it
RESOLVED, the Dallas Bar Association opposes Senate Bill 985.
